On Nov. 5, Porter was sentenced to two years of house arrest and three years' probation for leaving the scene of an accident that resulted in the death of two children. Her punishment has provoked many opinions. Starting Nov. 13, the St. Petersburg Times is running a series of stories that examines how lawyers and prosecutors sought to find justice in this case and what that means for those involved.

Mayor: relying on judges for justice

The preceived faults of the mother of the killed children certainly weren't relevant facts to Porters guilt. You do what lawyer Cohen does--try the victim to distract from the perps actions.

If judges and prosecutors could always be relied on to do justice, there would be no reason for electing them. This is a democracy, We all have a duty to assess how the courts are performing.

The Judge was presented with a plea bargain. There was never an exposition of the facts in court: not to a jury and certainly not to the judge. 

The people should have fired the prosecutor out of hand for this one. A trial would have given the kid's mother her chance at justice, given the public a different set of fact to review this case and perhaps even done justice.

As it is now, what we have is a plea deal that thwarted all those positive civic goods. Fire the prosecutor!!!!!!!!!

I think, in all justice, she should have done jail time for leaving the scene of a killing.  Lawyer Barry Cohen's excuse that she ran away because she was afraid of the black people at the playground where she'd killed the children is apalling.  The man is a cretin--a manipulator whose view of the justice system is disgusting. He's a rascist slob who demonized the children and their neighbors to avoid justice for a client.

I think her dad is a miserable shit, who participated in a felonious cover-up and who should have spent years in jail thinking about his civic duties.

This whole episode is disgusting. Porter is disgusting. Her family is disgusting. The prosecutors were incompetent and disgusting and Cohen is a positive civic evil.

Do people really think Lisa

Do people really think Lisa was a bad mother for letting her kids go to the park with their teenage brother? Could someone please tell me what is wrong with this? By the same token, I do not think Jennifer should have been charged with anything. It seems to me that everyone involved was just trying to live their lives the best that they could, and fate dealt them all a cruel hand. I think in our reactions we need to examine ourselves. How many times have you sped, been distracted driving, not used your turn signals, forgotten your wallet, thus drove without a license, been in a hurry and went through a red light, changed lanes too much, too fast, or without turn signals, or missed a stop sign? Never? Do you think these people are out there planning to hit or kill someone in an accident? The lack of understanding of the grief everyone involved feels is appalling in all of the cases discussed here.

The Blame Game

It sorrows me that so many people feel the need to play the blame game with this case. No one person is solely responsible for the death of these children. There is tragedy, loss, and pain on both sides. I was a student in the 7th grade of Liberty Middle School, the same grade and school as Bryant Wilkins was in, at the time of his death. I had to crumble in my desk at the news that he had been killed in a hit-and-run, and I had to shed bitter tears as they held a memorial service for him. I had to create a piece for the service in art class. At the same time, I am a dance student of Jennifer's at her studio. I can testify that she is a loving, innocent, kind-hearted person who would never have intended to leave those children had she been in her right mind. I have never met someone so genuinely sweet. It hurts me deeply to hear what people call her, to listen to the judgements thrown her way. How can people say she has no remorse, when she has tried to kill herself, believing she should have died instead? It was wrong for her to leave the children there, it was a bad decision. But who can say that they know for sure what they would have done in her situation? And who can call Lisa Wilkins a bad mother when every mother has made at least one mistake in their parenting. Bryant was almost fourteen years old. It would appear that he was competent enough to cross the street without his mother. Both sides made a mistake. Both should be forgiven. I empathize with both Jennifer and Lisa Wilkins, knowing that both are scarred for life and will never fully recover from this ordeal. So why must everyone make the situation worse by pointing fingers and calling names? Please, can we leave the situation alone so wounds can heal, and stop judgement when we have no right to judge? No one knows what truly happened besides Jennifer herself, and she lives with the regret every day. I see in her eyes a permanent sadness. Isn't it enough that she must live with what happened?

After four months, John Trevena mentions the lawsuit settlement, but he clams up on the details.

CLEARWATER -- Lawyer John Trevena is known in legal circles as someone who never passes up a chance for free publicity.

Trevena's media savvy presented Pinellas County officials with something of a dilemma recently. They wanted to settle a lawsuit Trevena had filed against Sheriff Everett Rice's office. But they didn't want to read about it in the newspaper.

So how do you keep Trevena's mouth shut?

County officials managed the trick (for a while) by telling Trevena that his client couldn't collect a $1,350 settlement unless the lawyer promised in writing to refrain from publicly commenting about the case or the settlement. He agreed.

Breathe a word and the money would be forfeited.

"We just didn't want him blowing his own horn on our account," Domenick Murano, Pinellas' risk management director, said Friday. "It's not like the county wanted to keep it secret. We just told him not to go and make a news story out of it."

That would have been the end of the story except for one thing: Trevena spilled the beans four months after signing the agreement.

Trevena, saying he was honoring his agreement with the county, refused to comment about the case or settlement. But he said he felt he was free to simply mention the case was settled. The unusual agreement is in a public court file open to anyone.

Murano agreed that Trevena was not in violation of the agreement by simply revealing the existence of what is, after all, a public record.

"He can tell anyone he wants," Murano said, as long as the lawyer doesn't offer comment about it.

Trevena filed a lawsuit on behalf of Gary DiViccaro, who was arrested by Pinellas deputies in January 2000 on charges that he tried to scalp Tampa Bay Buccaneers playoff tickets to undercover detectives. The charges were later dismissed.

The suit said the Sheriff's Office falsely arrested him and also violated his Fourth Amendment right to freedom from unreasonable search and seizure.

In a bit of irony that's hard to miss, Trevena's suit says his client's rights were violated because deputies allowed a TV news crew to videotape the arrest.

Trevena's practice has a penchant for getting odd or newsworthy cases. His name has been in the news more than any Pinellas attorney in recent years. He's represented everyone from a man charged with impersonating a police officer for wearing an LAPD cap to the family of a teenage babysitter who found herself handcuffed at gunpoint.

On Friday, Trevena said the county was trying to avoid more publicity with the agreement.

"It's frightening that the sheriff and his legal henchmen are trying to subvert the First Amendment," Trevena said.

It's not unusual for private litigants to agree not to discuss a settlement. But almost all the county's business is, by law, open to public inspection, making nondisclosure agreements a rarity.

Murano said there is nothing illegal about the agreement. He says the idea for it came from Assistant County Attorney Thomas Spencer.

Spencer said the county wasn't trying to hide anything about a settlement that is in a public file.

He said, "I don't try my cases in the media after the fact. Mr. Trevena was ready and willing to agree that he wouldn't engage in such behavior."

Murano said he cannot recall the county asking an attorney to agree to such a stipulation in his 20 years in risk management.

Sheriff Rice, beneficiary of the nondisclosure agreement, doesn't much care whether Trevena comments about the lawsuit.

He said he didn't insist on secrecy.

"I've developed a thick skin about a lot of things," he said. "As long as they tell the truth, I don't care what people say about me

Columnist asks about leadership

Ernest Hooper's column raises the issue not of who did what to whom but what lessons our elected leaders can learn from public dissatisfaction with the outcome of the Porter case. In other words, after we wring our hands, point their fingers at one or another of the women involved, and decry a system that creates a justice many do not accept, where do we go from here?

Start With Sex Ernest!

Words have gender, Ernest; people have sex. So it follows that no one gets a break because of their gender because gender refers to masculine and feminine forms of words. Words dont get legal breaks, people do.

jennifer porter was'nt spared because of her race, nor was she spared because of her lawyer. she was spared cause she was a female, an attrative female at that. our judicial systems and judges , turn a blind eye to the law and punishment when someone attractive and female violates the standards of our society. they use every mental disorder they can muster up, and give a pouty look to the judge , and he or she softens up the punishment. this is our fault as citizens who have the power to stomp this out , by making it clear to the judges , if someone does the crime there should be equal punishment regardless of gender and race. lets not turn a blind eye to this ,and to any blatent imbalance of our courts toward gender {ie Debra LaFave to name another one). to the mother of the children that were lost, you are in my prayers. m johnson

Not True! Sometimes It Favors The Ugly, Fat Ones, Too.

I recall a trial where Claudia Isom was the judge. At the beginning of the trial the female defendant was crying and Judge Isom left the bench and gave the woman a hug. I sensed the ultimate outcome. Isom ruled for the fat, ugly chick.

Amazing

It amazes me how people can comment on what kind of person Lisa was and is. How people can talk about how ghetto she is and what kind of lousy role model she is for her children. Regardless of the kind of person the dead children's mother is or was, those children were hit and left to die. I myself roll my eyes at women like her because they should know better or at least at some point get the point. No, I don't think Porter should have gotten life, but the fact that she serves no time at all is sickening.

I wonder, why is it that I'm trying to raise my children to respect others? Why stress education to them everyday? Why do I teach them good family values and right from wrong? Why should I? Should someone come along and leave my children for dead in the middle of the street I'd have to worry about the fact that they really are good people who could afford an attorney that can work the system and get them off with a slap on the wrist and make people everywhere feel sorry for them. I mean if we live in a low income neighborhood the kids probably just ran out into the street in front of the car playing tag or something. Since it's likely none of my children have the same father, well that concludes that I'm a sorry mother of low moral fiber and it's really my fault anyway. It would be obvious that it was bound to happen to those little statistics.

Reading some of the comments, I'm afraid for my children. Living in a world filled with people that think it's okay to leave children for dead in the road because their mother wasn't a good mother. If Porter would have gone to a payphone to call 911, okay. If she would have gone home and called them from there, okay. She didn't. She and her family covered it up like it never happened until they couldn't anymore. I don't care about the lights or who Lisa is, those babies didn't deserve to be left like roadkill no matter where they lived or who their mother was.

By all accounts this is sad and tragic. The story is appalling. A mother who adored her children has two children taken from her, and a seemingly sweet and good lady finds herself responsible for the deaths of two people and a family's sorrow. I find it equally appalling that so many people are so quick to act with blame and judgment. I can't understand how people, including most who have responded to this thread are so quick to hate. Must we always resort to hatred and division, and blame? Sometimes a tragedy is just that, and we should not try to find solace in holding others responsible. I am a white Jewish male with a black Christian girlfriend, and I can tell you that the world is a much better place when we embrace each other instead of seeking out division. The reactions of the people of Tampa, both white and black were dispicable. Best of luck to Lisa and Jennifer. I think they are both strong ladies who got a raw deal.

LET IT BE

It's just my feelings that there are no real winners in this case. Sad and tragic indeed, I do not believe that Jennifer Porter left the scene with any "malicious intent". What happened, is that she "panicked" and went home to where she felt she would be safe; not safe from the law or to hide anything, but safe from the reality of what had just occured and which at the time, could not fully negotiate or comprehend its true presence. I feel that her parents should be held more accountable than her as a matter of fact, considering that they procrastinated to the extent that they did, encouraging and hoping to conceal evidence. This was not quite moral in that regard. In any event, I feel that justice was served and the sentence for JP was appropriate.

Aquina Wilkins said, “The lights was off of the car…." And that the driver “was listening to music and it was kinda loud….”
Accepting Aquina’s statements, which ring true, Jennifer Porter, possibly zoned out listening to “smooth jam,” was driving with her lights off well after sunset, in fact almost completely dark, and driving on a stretch of road with streetlights out.
And a body hit Jennifer Porter’s windshield and so she drove away, not remembering anything for the next 18 minutes, the length of the gap in the Nixon Watergate tape.
If Jennifer Porter turned her headlights on, a conscious act it seems to me, WHEN did she do so?
If we know that, we may know all.

I do enjoy reading these

I do enjoy reading these posts and like the new "it's your times feature".
First, I would like to say the two cases differ in too many ways to compare them well. There was a similar case where all the parties were white and the outcome was the same as the Thornton case. The only place there might have been a racial decision was in placing the charges originally. I strenuously disagreed with Thornton being charged as an adult. In cases of vehicular homicide, the families of the victims must agree to the punishment. I feel (I know I will get lots of flack about what I am going to say) that the punishments for these drivers is too harsh, period.

Never? Do you think these people are out there PLANNING to hit or kill someone in an accident? Should they pay with prison time, espically in the light of the problems at DDC? Are they bad, malious people who are recklessly driving around hoping to hurt someone, or are they people just like you and I. Most of the people I have read about who have gotten 30 years were not even drunk or intoxicated on drugs. Most of these are not bad people. The lack of understanding of the grief everyone involved feels is appalling in all of the cases discussed here.
Maybe Lisa believes in God and doesn't believe in family planning. Believe it or not, young children still walk some distances to school. They are as young as the children who got hit. Now you are saying they should not have been out playing?
Maybe if Jennifer had been black the sentence and charges would have different. There was room for more charges, not only for her, but her parents as well. And SO someone saw a white van. Jennifer's car had blood on it and a cracked windshield from hitting a child.
Maybe if Jennifer had been black and the family had something to say about it, she would still be right where she is now.
I believe the need for overhauling the laws is desperately needed. These drivers need counseling and drivers caught intoxicated can have breath meters put in their cars and receive drug and alcohol treatment and analysis as part of their punshiment. At the very least, they would be better off in a facility where they are all together and apart from other types of criminals and go to school to earn a degree. Remember the next time you speed, look away from the road, don't see a pedestrain, run a red light, speed through a school zone, talk on the phone, glance out the window too long, miss a stop sign, go the wrong way on a one way street, don't use your turn signals, drive without lights at night or in a storm, spill a beverage on your lap, race a car for a few feet, or any other driving mistake you can image, THIS could be you we are talking about here.
And mothers; think about the time the phone rang, the doorbell rang, you had to use the toilet, take a bath, do laundry, cook, clean, work at the office, and all the other chores you do. Have you never left your child a moment and some little thing happened? It happens so fast you don't have a chance and it happens to many loving, caring parents. Their child dies of an accident. A bookcase falls, they fall in the pool, they swallow a marble, a baloon pops and a piece lodges in their throat, or fall from a tree and a branch pierces their brain. It can happen to anyone and we could be talking about them/us right now. I view these drivers as unfortunate people who made mistakes and many pay with their lives. Jennifer not coming forward is just beyound analization. And the people in her life helping and supporting her made things more tragic. I don't know what she feels and neither do you. It's not possible to know how a person thinks and feels.
I hope we change the laws to stop lynching young drivers for mistakes such as these and start doing something productive with and for them all.

HEllo people. wake up do you relize she got off with murder and do you know why she did hmm. does barry cohen ring a bell.. just look at him in the court room calling shots he is a high profile lawyer i think if she had a public defender she would be in jail or be waiting too go prinson by no questions ask... on that matter and for the mother of the two kids i think she should be charged too with some type of crime or legal thing... she wasnt watching her kids at the time so child protevtive service should be bringing her too court next... and for ms porter too say she didnt stop cause in her eyes or words.. she thought it was the ghetto.. cause of her nice home in land o lakes is in a all white neighborhood i cant post the adress on here but you can look it up on on the web site call pasco county propert tax web site and then you can see how ms porter lives well thats all i have too say she got off scott free 1 she was white and two she had wasb barry cohen on her side . the mother had no one accept a county paid D.A that didnt do his job very well...

I really believe if this was turned around and Ms Jennifer Porter was the victim and Ms Wilkins was the suspect she would have been sentenced to death or life in prison for the murder of two children and a hit and run leaving the scene of an accident. Everyone knows this!!!!! I am very disappointed in the judicial system. I seriously think this whole case should be tried in front of a jury.
Everyone needs to understand and realize and face the FACTS that politicians and legislation in Florida want a vote from the Hispanic culture and this is why Ms Jennifer Porter literally GOT AWAY WITH MURDER.
My condolences goes out to Ms Wilkins and her family for her thier loses. She is the victim here and her family and pray to God that this case be tried again. And stop saying that this was a woman in distress because that is not the case here people this Ms Porter woman knew what she was doing and if she didn't then she was on something like drugs or alcohol???? Was she even tested for such substances probably not!!!!! Is she even a legal citizen in this country????? I am watching all over the United States about Illegal Immagrents literally get away with murder and I am sick and tired of watching these victims family suffer because of a vote marking. I read these comments and I have read all the news articles in regards to Jennifer Porter; every last one of them. The reason, because Jennifer is my cousin. I have watched her go through a living hell since this awful, dreaded day. What irritates me sooooo bad is the fact that all these people who comment, really do not know what they are talking about. For example, tommy D, she got off with murder? Excuse me, she was not charged with Vehicular Manslaughter. Why not, because the authorities, Sheriff's Dept. and State Attorney's office knew that that charge would not hold up in court. Remember, there was a white van involved that that driver was too cowardly to step forward, and possibly a third car. Jennifer's story has never changed! Ms. Wilkins has, so has Aquina's.

Mr. Cohen showed the transcripts of what Aquina had told authorities in the hospital and she said "a bus" was coming; "we got to the second line in the road and we saw a bus coming so we backed up.....". This article your paper wrote stated that the Wednesday after the accident, while at home, Aquina is questioned by the state attorneys office and others; Aquina now says, "it was a car with a lady with brown hair in a ponytail and wearing a dress." GIVE ME A BREAK! If that is not proof of leading a child's testimony, what is? After receiving a degree in Criminology and working with Juveniles delinquents and young children in various aspects of the court processes, I learned early on that there is a specific way that you question children, YOU DO NOT LEAD THEIR TESTIMONY! With this being said, I will believe what Aquina testified right after the accident, not after everyone corrupted her mind! If anyone of you who want to comment was in court on Nov. 4th, you would have also witnessed this exact same coercion by Ms. Seace, the State Attorney. I commend Mr. Cohen on the way that he put Aquina on the stand and let her speak to Judge Battles, "from her heart", as Mr. Cohen told her. He never once interrupted that child, she freely spoke. Ms. Seace totally lead that child's testimony.

Secondly, I always read about The Porter's and their nice home in Land O' Lakes. Excuse me! THEY ARE NOT RICH! Mr. Porter (Greg) works at the Post Office (not in an executive position; he sorts mail and does labor work for the past 20 years or so) and Lillian is a teacher's aide. They are part of middle-class society. Not one's that can afford a high-profile attorney. Did it ever occur to anyone that possibly Mr. Cohen believes in Jennifer and did this out of the kindness of his heart. See, I always knew that God had his hands on this case and Mr. Cohen, to me, was the first sign. Thank you Mr. Cohen.

Thirdly, Jennifer did not get off scott-free! She has spent four years on a degree of Education. She is now a convicted felon. She will never be able to teach in the public schools again; she will never be able to vote; she will spend the next two years confined to her home, her next three years on probation, 500 hours of community service hours (plucking turkeys prior to Thanksgiving (sorry, but to me that is degrading!) and a LIFE-TIME OF REMORSE AND SORROW FOR THE LIVES LOST IN THIS TRAGIC ACCIDENT. Some people may just be able to get over something like that but Jenny, no...See she has a heart. She will always grieve for these children! She has been grieving those children's death and to this day she would take their place in a heart-beat if she could. She is a very sweet, loving person. Not this cold-hearted bi_ch everyone loves to portray her as. Thank God she also is very strong hearted that she can deal with all the negative comments the whole county, as well as, the country has been dealing her.

We live in a free country where we all have freedom of speech, and the media has the right to portray stories anyway they see fit. Unfortunately, the media has been the one to fuel the fire on this story. For example, after the sentencing, not one reporter came up to any of the supporters of Jennifer and asked us how we felt about the outcome. They sure went out to 22nd Street to get their opinions. They sure asked people on the street that were not even there, in the court, to hear the expert testimony of the Psychiatrists that examined Jennifer and explained how the human brain works and what happened to her's in this case. A matter of fact, two reporters did come up to me, one from the Associated Press and the other from Fox News and asked me what "Community Service was". My answer, "If you are going to print it, look it up!" That is the problem I have seen with the media this past year and half; they got half their story right and never followed up with the other half.

If the people in this community cared so damn much for Durontae and Bryant they should be outraged that the Sheriff's Dept. just drops the ball on this investigation. Oh by the way, how many of you out there knows that it was a contaminated crime scene from the beginning. The investigators never could mark the bodies in the road because of people picking the bodies up (with good reason, I probably would have done the same thing.) My point though, is the State Attorney's office theorized this whole scenerio when they could not have even told you if the children were hit by a north bound car or a southbound car. According to Aquina's initial statement, "they backed up" after getting to the second line in the road (the middle line?). They were all walking in a straight line with the older siblings in the front and the back with the small children in the middle. Aquina was in the back (she testified), that means Bryant was in the front....My theory he was hit by the southbound car ("the bus" as Aquina testified, "the white van" which 12 others testified to) and thrown into the air landing on Jennifer's windshield. Some of you probably think I am just talking out my a__, however it is a "theory" exactly what the State Attorney's office had! (Get my point?) They also had three different investigators on this case. For some reason the first two quit, or were reassigned, the third was the one who finally followed his "investigation" (theory) through. He came upon the case on Sunday, four days after the initial accident. He testified that he was at home the night of the accident.

I could go into the racial thing too, but I have to much dignity and pride to not subject myself down to that level. THIS IS NOT AND NEVER WAS A RACIAL THING! I have been trying to contact Geraldo Riveria at Fox News in New York for the past three weeks in regards to his program that aired with members of the Uhuru group and another Afro-American lawyer in this community (not to mention, neither of these two individuals knew anything about the case, they just wanted to throw that race card in there to stir up society.) After numerous e-mails and direct phone calls, the man (Geraldo) is ignoring me. He doesn't want the truth on his program, that, or possibly he knows he was so ignorant that he does not want to admit his fault on his own program.
Like I said before, I truly believe that God has been involved in this case from the beginning; not for any one specific person either. There is much to be learned from all sides in this case. For some reason, I don't feel that this story is over yet. I pray every night for Ms. Wilkins and her family. I pray for Jennifer and I pray that God will keep my children safe and healthy. I also pray now, right now, that no other kind-hearted person, such as Jennifer, will ever have to go through the ridicule, the hatred and the injustice like Jennifer has this past year and half. If that is not punishment enough, I don't know what is!
One last thing, Thank you to the writers of this 5-day article. This was probably the most honest and open-minded article I have read on this subject and I thank you for portraying this case as it is. Thank you. God Bless to all of you.

had she done what every citizen using public roads is commanded to do when there is an accident that involves the driver,that is stop render aid and call police. it isnt the fact she hit these children, it isnt the fact she drove home, while the children lie dying or dead on the side of the road. it is the fact she didnt stop, she didnt call, and she didnt care. actions speak louder then words.

As a former insider it's often amusing and frustrating to observe how the media and public are led around on a leash by government agencies. And this happens because reporters dont do their homework to learn who has a dog in the fight and who wins or loses if the investigation goes one way or another. Another salient point is: Guys like Bill O'Reilly and Geraldo always have a stake in how the story gets spun. Their ratings and money depend on making someone 'it" and then beating them up. And they want to be perceived as Crusaders for the Little Guys. I've observed O'Reilly launch self-righteous tirades about stories I'm certain he knows nothing about, because I happened to know what really took place from reading all the relevant reports and speaking with the investigators. There's no O'Reilly Show if no one gets harpooned and bludgeoned.

Well Frank I am glad you made that comment. I don't agree with you about why Ms. Wilkens has so many children. I think she does it because of lonliness and fear. I do think the whole world needs to start taking a serious look at how many people are being brought into the world. It does not seem like we can properly take care or all the kids we have now, not even in America so why are we not taking this population growth more seriously? Well Lucy everyone has the right to their own opinion, hopefully your opinion is not shared by too many. Our prisons are pretty full as it is. I for one don't believe in punishment for say. I believe we need to help each other be better people. I know there is those among us that have to be locked up to protect us and them. I believe there are to many people released from prison that are still a danger. This is because as a society we have come up with what we feel is the appropiate punishment for certain crimes. Example: California has the three strike rule so a person winds up in prison for life for stealing. Then I seen on the news where someone got 15 years for murder. We need a system that really makes our world a safer place. Putting Jennifer Porter in prison for life does not make our world a safer or better place. When ever we as a society do anything out of anger or fear we are not making our world a safer or better place.

Anyone who commits a hit and run is only concerned about themselves. They run not because they panic or don't know what to do, they run because they know they've made a mistake and don't want to be caught. A person with moral who witnesses an accident would stand by until authorities arrive, much less for a person who is involved in the accident to conveniently run when they think no one is around. If you dont like the law work to change it! You really can make the law whatever you want. Take teen-agers. If an 18 year old has sex with a 17 1/2 year old the 18 year old can be convicted and designated a 'sex offender.' Forever! Doesnt matter if theyre in love and get married. And when they have a baby you can call the Child Abuse Hotline and whine that the baby is in the home of a nasty pervert. Tommy? The laws are arbitrarily enforced by the state attorney and law enforcement. I personally think it stinks to arrest and convict an 18 year old for having sex with a 17 year old, but I know it's done (especially if mommy & daddy have horns to gore a state attorney with), and what you personally believe about it is misinformed opinion. Lisa Wilkins wasnt arrested and charged with felony child neglect, either, but I know for a fact a charge could have been made and prosecuted. The kids died, so they were not being adequately supervised. That's the proof: They died while supervised by a kid. If Jennifer Porter had stopped the kids would still be dead and Porter would have been charged with nada. My guess is HCSO didnt want to deal with a manure storm from outraged citizens, and the state attorney didnt think a jury would convict Lisa. DCF, of course, looked the other way. If the kids had fallen in the bath-tub, let's say, DCF would have moved into the home with a fleet of socialist workers and assorted do-gooders. Or if Lisa had left the kids alone with the sibling and the house caught fire. Same thing.

I have read and appreciate the posts here. I appreciated being able to see other's opinions.
I will now post my view.
The accident most likely happened because street lights were out near a playground, and a driver was unable to see dark skinned children probably dressed in dark clothing crossing the street before she apparently struck them in the darkness.
I cannot bring myself to fault Lisa Wilkins as to her fitness as a mother. I gather from the Times' series that there was great love in the family, and that all they had in this world was each other. There are many Lisa Wilkins' who have a hard life yet manage to keep their families together. I have no doubt that her son, had he lived, would someday judge right and wrong by asking himself "What would my Mama say?" Who dares step forward to judge this woman?
Nor can I fault Jennifer Porter or her family. Of course I cannot know exactly what went through their minds when they held off reporting her involvement, but I accept that she did not flee to avoid prosecution for what had happened. She and her family panicked, and in this panic they did things which they would not have done ordinarily. They were simply afraid of the unknown, as we all are.
And like most of the rest of us, they did the right thing in the end.
Jennifer, unlike Lisa, had led a very sheltered life. But there was also a lot of love in her family.
To the respondant who stated that all that had to be done to get the street lights fixed immediately was to report them broken, I can only say that it does not often happen that way. You would think that streetlights close to a playground would get priority, but evidently this is not so. I can also understand the residents of the area going on about their lives without expecting those responsible for the lights to do anything soon about them.
To those who would fault Jennifer Porter for speeding, I would ask you where can you drive without seeing almost everyone speeding at least 5 M.P.H. over the speed limit?
To those who would state that Lisa Wilkins will be foolish with the money she received, I can only say, that from what I have read about the lady, I do not think this will happen. She lived in a far different world than many of us, and she has a lot to learn about handling money, but I think she will be all right.
To those who would make this a black versus white issue, I will bluntly tell you that you only wish it is to suit your own issues.
And to whichever person who decided to put the repair of those streetlights on the "back burner", I will tell you that you are indirectly responsible for the deaths of two children and a lot of heartbreak.
To the Times, I thank you for the series, even though I know that no newspaper publishes "the truth, the whole truth, and nothing but the truth". Your reporters perceptions may have been tainted, but they did an excellent job.
And finally, to Lisa and Jennifer, I will offer my hope that they will each be able to recover from this tragedy, and that the rest of their lives will be happy.

I posted here a few days ago and got replies from this Southcarolinagirl poster that pretty much informed me that if the police hadn't killed one of my family members, I couldn't relate to her and the "black experience." If I weren't black I couldn't understand, this, that, or this, or that, or this, or that or the other thing, etc, etc. I got the same thing from this Freefloater or Freeloader fellow. Almost identical. Pretty much, "I'm a victim and it's your fault."

Jennifer Porter Case

Your thoughts on this case parallel mine. I could have been in a similar situation one night on my way home from playing volleyball. I was north bound on Highland in Largo. There was a bicycle in the south bound lane that had my attention because of automobile traffic coming up behind the bicycle. Highland is not wide enough at the location I was at for a car to pass a bicycle with out coming in to the on coming lane. You can never be sure what a driver will do when passing a bicycle and especially at night. The bicyle had lights but of course they were not as bright as car lights. Suddenly my passenger told me to look out for the bicycle. There was a bicycle going south bound in the north bound lane without lights. Fortunately that warning enabled me to avoid the bicycle but if not for my passenger it could have been quite different. I am very thankful that I did not hit the bicycle. I know it is something that would have greatly effected my life. I would have not been at fault, I probably wasn't even speeding. I try to do the posted limit or less on city streets. It is my belief that if you are speeding and get into a accident you share part of the blame, no matter what the other circumstances are. I wish cars had devices in them that kept you aware whenever you were going over the posted limit.
I do disagree with you a little about the street lights. Perhaps if the area had been better lit things may have been different but we will never know. As a bicycle rider I know it is very important to never assume the driver of a vehicle see's you. This is also true for pedestrians. Ther are so many things today that can have the attention of a driver.
I just read a phamplet on bicycle safety and it talked about making eye contact with the driver. This is a very good idea but let me tell you about another close call. This time I was the bicycle rider. I had just crossed US 19 at Tampa Rd. I was going west on the south side sidewalk. Let me say here that whenever possible you should travel with the flow of traffic even when your on a sidewalk. When a driver is approaching a road from a driveway there first attention is to the traffic in the first lane they are going to enter or cross which means they are going to look to their left. Back to my close call. There is a gas station on the south west corner of Tampa Rd. and US 19. There was a pikup truck pulling a trailer setting back a ways from the sidewalk. It was not moving at all and I couldn't tell if it was even running. The best thing I could have done here was to make eye contact with the driver. I didn't even know if a driver was in the vehicle because of the window tinting. As I was about to cross the driveway the truck started to move fortunately the driver seen me.
I try to operate any vehicle that I am in control of safely but some times you let your gaurd down and then you can only hope it is not at the wrong time. There is alot of electronics availible today to make are roads safer but it is slow to come. Yet ten's of thousands of people are killed or injured on our roads everyday. One would think that we would doing everythng in our power to make our roads safer. Like reducing the speed limit on US 19 in Pinellas county to a max of 45 and slower in conjested area's. The speed limit on our freeways is 55 in Metro area's so how can you justify 55 on US 19?
Leaving the scene of a accident. Not usually a good idea unless you feel it is unsafe to stop and then you can find a safe place and call the police. Sounds pretty simple and maybe the majority of us would react in that way. I assume I would but who knows for sure. I am 56 years old and have been in many emergency situations. I was a volunteer firefighter for 16 years and went to many accidents and seen some gruesome things. What I know from that experience is that we can never be sure how we are going to react at any given moment. There are so many factors, even if you have been trained to react a certain way you can not be sure how you will react at any given moment or at lease that is true for me. It seems as a society we are quick to judge before we have all the facts and then it seems we judge harshely. I feel we need more compassion. If Jennifer Porter would have been sent to prison would that have made her a better person or would it have made our world a better and/or safer place? I think not. The accident alone should have made our world a safer and better place because it should have made everyone a better driver or at least some of the times. Jennifer Porter life has changed and she can no longer be a teacher at a public school. From what I read she was a good teacher and liked. So how does taking that away from her make our world a better place when good teachers are hard to find?
I will close with this thought. Don't be so quick to judge as none of us is perfect and we all make mistakes, some of us just pay a higher price for our mistakes.

Porter Case

This case has caused so many emotions in so many people. In regards to the comments left by JBones....
Although I have never personally traveled that section of town, it would seem that anyone that had any type of intelligence would think that slowing down in an area that is as poorly lit as everyone has stated would be the "right thing to do." Sadly, I too have seen many drivers (even in inclimate weather) drive far too fast. I live in a predominately black neighborhood and it's not unusual to see people (not of the same neighborhood) sometimes driving a little too fast this inlcudes school zones. And yes, there are signs and lights blinking and cones asking drivers to slow to 10mph. I guess the closeness of the playground never impacted her decision to maybe decrease her speed. I like to think that a "teacher" (no matter the subject) would have children and their safety at least on her mind. Lisa's "fitness as a mother" does not mean that her children should have been hit and left. Let's say it wasn't Lisa's children, but my older teenagers on that same section of road. Does that mean that Jennifer would have been more or less responsible? Would that have changed anything about the case. No matter what Lisa's station in life, that doesn't mean that her children should have been taken away from her in such a manner. As to what Lisa does with the money, that is noone's business but hers. She can do what ever she pleases with the money. At least that is the part of Lisa's life none of us get to govern. I have read far too many statements that Jennifer was a good person and was taught "right from wrong." There was nothing right with anything that happened in the hours or days that followed. Was it right to wash her car? Was it right to wait to come forward to tell the "truth"????? Was it right to go to work the following day and act as though nothing happened? Had she hit an animal, would she have done anything differently? I too lived a sheltered life (as I am sure many people have), and was taught right from wrong. I was punished (as many people my age were) for doing things that went against what I was taught to be right. One would like to think that it's not black vs white, but it just feels like it. I would love to put on my rose colored glasses and pretend that color is not an issue, but the only way to find out is if a woman of color hit children not of color and death resulted. Would she be represented by the wonderful Barry Cohen? Would she be allowed to be at home with her family (holidays, birthdays, etc.,) be allowed to worship? Maintain her life as almost nothing had happened? Would her past indiscretions have been made a part of public record? Finally, as to the rest of everyone's life being happy, Jennifer has the chance to have a first child. To see it grow, get married and have children or his/her own. Lisa will never see her first born graduate, fall in love, get married or bring forth life.
